Terms of Service

These Terms of Service (the "Terms") set out the conditions for use of Updraft (the "Service").
Users who use the Service ("users" or "you") must agree to these Terms before using it.
Article 1 (Application)
These Terms apply to all relationships between you and MS Lab LLC ("we", "us" or "our") concerning use of the Service.
Article 2 (Registration)
A service agreement is formed when an applicant applies for registration by the method we specify and we approve the application.
We may decline to approve registration in the following cases.
- Where the applicant has submitted false information
- Where the applicant has violated these Terms in the past
- Any other case that we judge to be inappropriate
Article 3 (Prohibited Conduct)
You must not engage in any of the following.
- Acts that violate laws or regulations or public order and morals
- Acts that infringe the rights of other users or of third parties
- Acts that interfere with the operation of the Service
- Unauthorized access, reverse engineering, tampering, and similar acts
- Automatically collecting information from the Service, whether by crawling, scraping, or any other means
- Using the API we provide beyond the scope of ordinary use through the screens of the Service
- Systematically reproducing or storing information published on the Service and providing, publishing, or redistributing it to third parties
- Using information published on the Service for commercial purposes without our prior written consent
- Placing an excessive load on the servers or network of the Service
- Sharing your account for the Service with a third party, or allowing a third party to use it
For the avoidance of doubt, referring to or transcribing individual calculation results or contents of the technical reference materials of the Service for your own design work or other ordinary business does not fall within the prohibited conduct set out in the preceding paragraph.
The quotation and reproduction of Posted Information (as defined in Article 11) are governed by Articles 11 to 15.
Article 4 (Intellectual Property Rights)
Copyright and other intellectual property rights in the Service and in all text, images, programs, databases, and other information that make up the Service belong to us or to the rightful rights holders.
The technical reference materials and similar content published on the Service include factual information based on published standards, including the Japanese Industrial Standards (JIS), as well as factual information based on product specifications published by manufacturers. We do not claim any rights in such factual information itself; however, rights in its selection, classification, arrangement, and systematic organization belong to us.
As to factual information based on product specifications published by manufacturers, we publish it with its source indicated and only to the extent necessary to provide the calculation features of the Service. Rights in that information belong to their respective holders.
These Terms do not grant you any rights beyond the scope necessary to use the Service.
Article 5 (Changes to and Suspension of the Service)
We may change or discontinue the contents of the Service without prior notice.
Article 6 (Disclaimer)
We do not warrant that the Service is free from defects in fact or in law.
We bear no liability whatsoever for any damage arising from your use of the Service, except where we have acted with willful misconduct or gross negligence.
We make no warranty whatsoever as to the usefulness, accuracy, legality, or safety of the content of Posted Information. Posted Information is published under the responsibility of the user who posted it and does not represent our views.
If a dispute arises between users, or between a user and a third party, it shall be resolved between the parties concerned. We take no part in such a dispute and bear no liability for any damage caused to you by it.
Article 7 (Paid Plans)
Paid plans may be introduced to the Service in the future.
We will determine the contents, fees, and payment methods of paid plans separately and display them on the Service.
Article 8 (Account Cancellation)
You may terminate your agreement to use the Service by completing the cancellation procedure in the prescribed manner.
Even if you cancel your account, Posted Information posted up to that time shall remain on the Service. In that case, the display of the poster of that Posted Information is changed to one that does not identify the user.
Notwithstanding the preceding paragraph, Profile Information (as defined in Article 11) does not remain on the Service when you cancel your account. We delete it, except where we are required by laws and regulations to retain it.
Article 9 (Changes to These Terms)
We may change these Terms where we judge it necessary. The changed Terms take effect when they are displayed on the Service.
Article 10 (Usage Records)
To improve the Service and to develop new features, we record how users use the Service while logged in (the pages viewed, the values entered in the design calculation features and the results calculated, and the operation history of features).
In addition, to improve the Service, we display surveys to users who are logged in and record the responses provided. Responding is optional, and if you do not respond, this will not affect your use of the Service.
The information recorded is handled in accordance with the separately established Privacy Policy.
Article 11 (Handling of Posted Information)
Copyright and other rights in the text and all other information that a user posts, transmits, or publishes on the Service (the "Posted Information") belong to the user who posted it, or to the third party who licensed its use to that user. The display name, self-introduction, profile picture (icon), and other information that you register as your profile on the Service (the "Profile Information") is included in Posted Information.
Where maintenance, improvement, or other operational needs of the Service arise, we may reproduce Posted Information to the extent necessary.
For the purposes of advertising the Service and of commercialization derived from the Service (including, without limitation, publication in book form and other secondary use), we may use Posted Information (excluding Profile Information; the same applies throughout this paragraph) free of charge (including reproduction, copying, modification, translation, public transmission, sublicensing to third parties, and any other use), and you grant us that permission perpetually and irrevocably. However, where we use information within Posted Information by which an individual can be identified, we will obtain the prior consent of the user who posted it.
You represent and warrant that your Posted Information does not infringe the rights of any third party and that you have the proper authority to post it.
You shall not exercise your moral rights as an author against us in respect of the use of Posted Information under the preceding three paragraphs, and you waive those rights.
Article 12 (Prohibited Conduct Concerning Posts)
In addition to the conduct set out in Article 3, you must not engage in any of the following in relation to Posted Information.
- Defaming other users, us, or third parties, or damaging their reputation or credit
- Stating facts that are untrue
- Making conclusive assessments of a manufacturer or of a particular product on matters you have not experienced yourself
- Sales, advertising, solicitation, and similar acts
- Impersonating another user or a third party
- Publishing the trade secrets or other confidential information of a third party
- Publishing personal information without the consent of the individual concerned
- Acts involving obscene, violent, or discriminatory expression
- Repeatedly posting identical or similar content
- Posting by automated means
- Any other act that we judge to be inappropriate
Posts about a manufacturer or a product shall be confined to facts you have actually experienced yourself (specifications, delivery times, the content of their response, and other objective facts).
You must not quote or reproduce another user's Posted Information outside the Service, or publish it in any other medium, without our prior consent.
Whether any of the preceding paragraphs applies is determined at our discretion.
Article 13 (Deletion of Posted Information and Similar Measures)
Where Posted Information violates these Terms, or where we judge that it is likely to do so, we may delete that Posted Information or make it private, without prior notice to you.
We are under no obligation to explain the reasons for the measures under the preceding paragraph.
We endeavor to monitor Posted Information, but we are under no obligation to do so. There may be cases where we neither delete Posted Information nor make it private.
We bear no liability for any damage caused to you by the measures under paragraph 1, except where we have acted with willful misconduct or gross negligence.
Article 14 (Suspension of Use and Cancellation of Registration)
Where you violate these Terms, or where we judge that you are likely to do so, we may suspend your use of the posting features, suspend your use of the Service, or cancel your registration, without prior notice to you.
We are under no obligation to explain the reasons for the measures under the preceding paragraph.
Even if the measures under the preceding paragraph leave you unable to use the Service, we will not refund any consideration already paid.
Article 15 (Disclosure of Sender Information)
If we receive a request for disclosure concerning Posted Information under laws and regulations, we may disclose sender information (meaning the IP address, the date and time of posting, and other information) as those laws and regulations provide.
For the purpose of the preceding paragraph, we record and store sender information together with Posted Information.
Article 16 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan.
If a dispute arises in connection with the Service, the court having jurisdiction over the location of our head office shall have exclusive jurisdiction by agreement.
